Enforcement and more information
Hallmark International has self-certified that it complies with the U.S.-EU Safe Harbour Framework and the U.S.-Swiss Safe Harbour Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. Hallmark International has certified that it adheres to the Safe Harbour Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. To learn more about the Safe Harbour program, please visit: http://www.export.gov/safeharbor/. On October 6, 2015, the European Court of Justice issued a judgment that declared invalid the European Commission’s Decision 2000/520/EC of 26 July 2000 “on the adequacy of the protection provided by the safe harbour privacy principles,” (“Safe Harbour”). Safe harbour is a legal mechanism to permit transfers of EU residents’ personal information to the United States and to ensure that the information is legally protected at a level that is considered adequate by EU standards. Since the judgment was issued, the EU and US have been in negotiations to determine a path forward for Safe harbour and it is expected that information will not be available until the end of January 2016. Hallmark International has self-certified to the Safe harbour principles in the past, but in light of the recent judgment, has executed ‘standard contractual clauses’ with its EU subsidiaries who collect and export personal information in order to allow transfers and the continued protection of EU residents’ data during the interim period while we await further guidance from the European Commission. If you would like to contact us directly about the Safe harbour program, please contact us at Legal@Hallmark International.co. For individuals outside the European Economic Area, Hallmark International endeavours to comply with applicable law for the international transfer of your personal information. When Hallmark International receives formal written complaints related to personal information and privacy matters, it is Hallmark International ‘s policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between Hallmark International and an individual.
